Definitions
For the purpose of these terms and conditions, the following definitions apply:
The Club: NorthCowichanPickleballClub.ca
Student: An individual who books and receives sports instruction.
Coach: An individual providing sports instruction on behalf of The Club
Lesson: A session of sports instruction provided by a Coach to a Student.
Cancellation: The act of terminating a booked Lesson prior to its commencement.

Payment Terms
Payment is required at the time of booking for all private lessons, group lessons and court bookings through The Club website. For lessons scheduled over the phone, payment is required within 48 hours, or the booking will be released. The Club reserves the right to refuse lesson bookings from Students at it's discretion.

Refunds, Late Cancellations and Rescheduling
Full refunds can be offered if you cancel 24 hours or more before a scheduled session. Cancellations or rescheduling requests made with less than 24-hour notice are charged in full. Exceptions may apply for extenuating circumstances of an extreme nature, subject to review. Clients should contact The Club with an explanation for consideration.
Assumption of Risk and Release of Liability
1.1 Acknowledgment of Risk. By registering for or participating in any lesson, program, or activity provided by The Club , each Student acknowledges that sports instruction involves inherent risks, including but not limited to slips, falls, collisions, equipment malfunction, adverse weather, and contact with other participants. The Student voluntarily assumes all such risks and is responsible for determining their own physical readiness to participate.
1.2 Release of Liability. To the fullest extent permitted by law, the Student (and, where the Student is a minor, the Student’s parent or legal guardian on their own behalf) releases and forever discharges The Club, its directors, officers, employees, contractors, agents, and affiliated entities (collectively, the “Released Parties”) from any and all claims, demands, losses, damages, or causes of action arising from participation in The Club organized lessons, events, or the use of any facilities or equipment, including claims arising from the ordinary negligence of the Released Parties. This release does not apply to claims resulting from gross negligence or willful misconduct.
1.3 Indemnity. The Student (and, where applicable, the Student’s parent or guardian) agrees to indemnify and hold harmless the Released Parties from any claim, action, or proceeding brought by or on behalf of the Student or any third party arising from participation in The Club's activities.
1.4 Fitness to Participate. The Student confirms they are in suitable health to engage in pickleball or other physical instruction. The Club may refuse participation to anyone deemed unfit for safety reasons.
Amendments to Terms and Conditions
The Club reserves the right to modify these terms at any time.
Dispute Resolution
Any disputes arising under these terms will be resolved through mediation, subject to the laws of British Columbia.
